(KCEN) -- The U.S. Army Court of Criminal Appeals announced that it will not rule on the potential for Hasan to be forcibly shaved at this time.
The court says they will not rule on the issue until Judge Gross actually orders Hasan's beard to be shaved, which has not happened yet.
If Hasan is ordered to have his beard forcibly shaved, he will be able to file a petition with the U.S. Army Court of Criminal Appeals before he is shaved.
In the release, the court said, "The petition is denied without prejudice as premature because the military judge has not issued a definitive order for Petitioner to be forcibly shaved."
The stay in the case has been lifted and the case can proceed.
