Prosecutors in Colorado Theater Shooting Case Trying to Avoid Delays

Posted: Updated:

(KCEN) -- Prosecutors in the Colorado theater shooting case have dropped their request to review the notebook James Holmes apparently gave his psychiatrist before the mass shooting two months ago.

Seen at Thursday's hearing, Holmes now has short, brown hair instead of the bright orange, shaggy hair he used to have.

A district attorney in the case says even if prosecutors convince the judge there's no doctor-patient privacy with the notebook, the decision would likely be appealed.

Prosecutors say they don't want to delay the case against Holmes, who is charged with gunning down twelve people and wounding 58 others at a movie theater in Aurora, Colorado on July 20.
