(KCEN) -- Colorado theater shooting suspect James Holmes was back in court today.
This time his lawyers tried to delay a public hearing of evidence gathered against him.
The 24-year-old's attorneys say they need more time to go through almost 20,000 documents.
The prosecution agreed that they could use more time as well.
The scheduled preliminary hearing was set for November 13 but the defense hopes it won't happen until after the new year.
Another hearing will determine whether or not the judge will allow this to happen.
Holmes is charged with killing 12 people and wounding 58 others.
The mass shooting happened on July 20 during the premiere of the latest Batman movie in Aurora, Colorado.
