Testimonies Continue in Cummings Trial

UPDATE (KCEN) -- Pictures of the victims were shown in court and family members present at the trial had emotional outbursts. They began sobbing and almost had to be removed from the courtroom.

(KCEN) -- It has been a busy day at the McLennan County Courthouse.

Day two of Ricky Cummings murder trial is underway.

Given the situation, Cummings seemed calm and collective, even smiling at times.

The morning began with a Waco police and ex-girl friend of shooting victim Tyus Sneed.

Later Robert Sneed, Tyus's father testified about the night his son was murdered.

He described his son as a good kid. He says he saw Cummings as he was walking into his apartment wearing a black hoodie and Cummings greeted him.

Later after the shooting Sneed saw Cummings again wearing different clothes.

Emotions were high as he described seeing his sons lifeless body in the back seat of a car.

Tyus's friend Deontrae Major was next on the stand.

With a cold, hard look on his face he glared at the defendant, Cummings. He gave a detailed time line of what happened on  March 28, when he and his three other friends were shot.

He, Sneed, Keenan Hubert and Marion Bible, were listening to music and smoking marijuana when Cummings came up and, "mean mugged" them.

About 40 minutes later with no warnings, gun shots rang out from the back of the car.

Bible and Major, who were both in the front, ran for cover.

Sneed and Hubert, who were both in the back, didn't make it out alive.

After jurors left for lunch, attorneys argued whether Facebook pictures taken off Majors' page were admissible.

The judge ruled the defense's photos could not be used.
