Mountainside, NJ (PRWEB) January 21, 2013
The New Jersey issue of VerdictSearch, a leading publisher of verdict and settlement news and research in the U.S., featured Frank Smith’s settlement for dog bite injuries among its “Cases of Note”. Frank Smith successfully represented and settled for a security guard who was attacked by a Rottweiler and pit bull while at work patrolling an industrial building in Elizabeth, NJ.
According to Jon Steiger, an editor at the law publication, VerdictSearch "selected to feature this dog-bite case because the settlement is a significant amount and much larger than most dog-bite settlements.”
During the course of his rounds, the security guard was attacked and bitten multiple times by both a pit bull and Rottweiler that belonged to a tenant in the building he was securing, according to the lawsuit. Both the tenant and building owner were sued. The dogs were supposed to be kept in an enclosure, but were allowed to run loose.
Due to New Jersey’s strict liability dog-bite statute, the case’s liability issues centered on questions of ownership and responsibility for the two dogs.
Astonishing Result
The case settled for $563,501, reflecting the amount awarded following court-mandated arbitration proceedings.
VerdictSearch headlined the case as: “Security guard claimed he was bitten by building tenant’s dogs”, under the categories of Dog Bite, Premises Liability, and Animal Control.
The Client's Perspective
Hard working and deeply religious, the injured party needed more help in dealing with the trauma than his close-knit family and community could provide. When a friend recommended Attorney Francis M. Smith and he discussed his case with Mr. Smith, he knew he found someone he could trust and rely on. Sam Akinsanya, the dog attack victim, describes his relationship with his attorney, Frank Smith, to be one full of compassion and respect. "In addition to doing an excellent job in representing my case, Frank treated me with concern, empathizing with the trauma I experienced from an attack while working hard to do my job responsibly," reported Mr. Akinsanya.
Once VerdictSearch judged this case as one of NJ's Cases of Note, the case also became considered as one of the nation's significant cases by other periodicals.
