(KCEN) -- Almost eight months after the Aurora movie theater shooting, accused gunman James Holmes is expected to make a plea tomorrow in court.
Twelve people were killed and dozens more were injured when Holmes allegedly opened fire in the midnight showing of "The Dark Knight Rises".
Many speculate that Holmes will plea not guilty by reason of insanity.
And under Colorado law, he would then be examined by state psychiatric experts and his past mental health records will be used as evidence.
Legal Analyst Scott Robinson said, "It's a huge case socially and it's a huge case legally likely to create precedent good or bad that will govern future prosecutions."
Prosecutors have not said whether they intend to seek the death penalty.
After the plea they have about 60 days to announce their decision.
