New Motion Filed in Hasan Trial

 UPDATE August 7, 2013: 10:55 a.m. -- The Hasan trial has recessed until Thursday at 9 a.m. to consider the motion.

 


 

(KCEN) -- There has been a new motion filed in the Hasan trial.

The motion is called the "Motion to Modify the Role of Standby Counsel."

The motion was filed late last night by Hasan's standby defense counsel.

His defense is claiming that by helping him, they are compromising their ethics because they say Hasan is seeking the death penalty.

But, Hasan says that's inaccurate and the judge is making him explain it in the court hearing.

COL Kris Poppe said, "It becomes clear that his goal is to remove impediment or obstacles to the death penalty."

Hasan replied, "That's a twist of the facts."

It is unclear if testimony will go on Wednesday as planned.
