Texas Controversial Abortion Restrictions Blocked

Posted: Updated:

(KCEN) -- Abortion clinics around Texas will remain open ... for now.

A federal judge ruled tonight that abortion restrictions authorized by Texas lawmakers in July are unconstitutional.

The decision comes one day before the provision was supposed to take effect.

The ruling will prevent a major disruption of the abortion clinics in Texas.

Lawyers for Planned Parenthood across the state sued.

They say the measure would force as many as 1/3 of the state's 36 abortion clinics to close.

Judge Lee Yeakel's decision comes four months after Texas Senator Wendy Davis staged a dramatic 13-hour filibuster against the proposed restrictions.

The filibuster forced Governor Rick Perry to order a second special legislative session, passing the controversial law.

In a statement released just hours ago, Governor Perry said in part:

"Today's decision will not stop our ongoing efforts to protect life and ensure the women of our state aren't exposed to any more of the abortion-mill horror stories that have made headlines recently."

Senator Ted Cruz also spoke out about today's decision, saying in part:

"This law is constitutional and consistent with the U.S. Supreme Court precedent protecting the life and health of the mother and child. I hope the Fifth Circuit Court of Appeals will uphold Texas' reasonable law."
