PHILADELPHIA, Feb. 5, 2014 /PRNewswire-USNewswire/ -- A $5 million settlement, the largest ever reported in Sullivan County, Pennsylvania, will help Donald Adams, III with a lifetime of medical bills but he will still never walk again as a result of a 2008 accident resulting from a poorly designed and inspected portable toilet unit that left him a quadriplegic, according to his attorneys from the Philadelphia-based firm of Saltz, Mongeluzzi, Barrett & Bendesky, P.C.
Mr. Adams, 38 at the time of incident, and his wife, Amy, settled with defendants Poly-San, Corp., the unit's manufacturer, and Lewis Crawford, the installation contractor, and two individuals who shook the unit in the moments before it tipped over from its unstable position. The attorneys asserted that the unit toppled because it was not adequately staked into the ground and was installed on a slope on uneven ground. Mr. Adams, a father of two sons who was on a camping trip in rural Sullivan County, fell headfirst with considerable force.
"This case (Sullivan County Court of Common Pleas / 2011-CV-101) shows what can happen when a product installer chooses convenience over customer safety and a product manufacturer supplies a tip over prone product," said Attorney Robert J. Mongeluzzi, of SMBB, whose team including attorneys Jeffrey P. Goodman and Andrew R. Duffy, was prepared to try the case before a Sullivan County jury.
