Grand jury clears detective of wrongdoing in shooting of armed suspect

The detective involved has been cleared and will return to duty.

A McLennan County Grand Jury has found no evidence of wrongdoing by a local detective who shot and injured an armed man during a standoff earlier this year, according to the McLennan County District Attorney's Office.

The grand jurors on Wednesday declined to indict McLennan County Detective Joseph Scaramucci for the March 6 shooting of Robert Smith, 43, on Gerald Lane, after hearing the findings of an investigation by the Texas Rangers, a representative from the DA's office confirmed. Scaramucci was placed on paid administrative leave during the investigation, but the grand jury decided the shooting was justified.

Smith was booked into the McLennan County Jail after being treated at the hospital. According to online jail records, he remained in jail Friday on charges of being a felon in possession of a firearm, assault on a public servant and three counts of aggravated assault with a deadly weapon.
