Trial continues for former Baylor football player accused of raping woman

The trial for Shawn Oakman, a former Baylor defensive end accused of raping a woman after a night out in Waco, began Tuesday.

WACO, Texas — The trial for Shawn Oakman, a former Baylor defensive end, continued Wednesday.

Oakman is accused of raping a woman in the early morning of April 3, 2016, after a night out at a Waco bar. She was 22 at the time.

During opening statements, Oakman's attorney, Allen Bennett, said Oakman did not deny he and the accuser had sex, but they were in an exclusive sexual relationship.

Oakman's accuser cried while she was on the stand Wednesday afternoon. 

She testified she was never dating Oakman, and the two mostly engaged at his home. She said she eventually told him she did not want to see him anymore.

The accuser said on the night of the incident, she was at a Waco bar called Scruffy Murphy's, and had a few whiskey-coke mixed drinks.

It was revealed on the stand that she had texted Oakman and told him she was at the bar. 

The accuser then said she barely remembers sending the text, because she had too much to drink. 

She said on the stand she could not remember how she got to Oakman's duplex, but she did remember he was grabbing her arm to stop her from falling.  

She said she was so intoxicated she could not remember a lot of what happened, but testified Oakman had thrown her face down on the bed and raped her. 

During cross examination, the accuser told Oakman's attorney she did not start to feel pain until she sobered up at the hospital. She said on a scale of one to 10, her pain was at a five. 

The state called Waco police officer Danny Pilgrim as its first witness.

Pilgrim said when he arrived at Providence Hospital after the incident, Oakman's accuser was in a room with a nurse and friends. 

"She was upset," Pilgrim said. "Her face was red. She was crying. She was shaking." 

According to Pilgrim, the woman told him she told Oakman "no" when he wanted sex, but he pushed her back into his room and assaulted her twice.

The state showed the jury pictures of the woman taken by Waco police. The images showed redness around her knuckles, neck and collarbone.

The woman's clothes were inside-out in the pictures.

Pilgrim said he and the woman left the hospital so she could point out Oakman's duplex. Oakman was not home when Pilgrim went to the door, but a roommate let the officer inside to do a walkthrough of the residence. 

The jury was shown pictures taken of the residence during the walkthrough.

Bennett cross-examined Pilgrim, asking whether Oakman admitted to having sexual intercourse with the woman when the officer met with Oakman.

The judge overruled an objection from the state, and Pilgrim said Oakman did admit to having sexual intercourse with the woman.

Michelle Davis, the sexual assault nurse at the hospital who examined the woman the night of the incident, was also called as a witness.

Davis read the comments Oakman's accuser wrote on a sexual assault sheet when she went to the hospital. 

"'I kept telling him I wanted to leave,'" Davis read. "'He pushed my skirt up. I can't tell if he had on a condom. He had an orgasm. I put my clothes on and walked to Alicia's.'"

According to the nurse, the woman said Oakman also choked her. Davis said the woman  told her, "'I struggled breathing and he enjoyed that.'"

Davis said she did not see marks around the woman's neck, but there were tears on her vagina as well as open bleeding and bruises. The woman said her pain was about a five that night on a one to ten scale, according to Davis.

The accuser's friend Alicia Duval took the stand and recalled the night of the incident. 

Duval said she and Oakman's accuser went out with a third friend that night, and all three women were drinking. Duval said she did not find out Shawn's ex was leaving with someone else until it was about time to leave the bar. 

According to Duval, she texted the woman to ask where she was and whether she was okay, the woman responded "I love you." Duval said the text alarmed her.

Duval said the woman was afraid to say anything about the incident because Oakman played for the football team, and she didn't want her name in the media.

Duval cried on the stand as she described how her best friend had changed. She said the life had been sucked out of the woman and that she was no longer happy or outgoing.

"It's hard seeing your best friend go from completely happy to not wanting to live anymore," Duval said.

The judge said he hopes to wrap up testimonies Thursday. Court begins Thursday at 9 a.m. 

Editor's note: A previous version of this story identified Oakman's accuser as his ex-girlfriend. The accuser denied ever dating Oakman during her testimony, and this article has been updated to reflect that statement.
