Cedric Marks trial enters fourth week

6 News legal expert Liz Mitchel said the trial for Cedric Marks could go to mistrial any day.

BELL COUNTY, Texas — The fourth week of the Cedric Marks Capitol Murder trial begins at 9 a.m. Monday.

Marks is the man accused of murdering Scott and Swearingin back in 2019. He is representing himself in the double capital murder trial. 

On Friday, forensic analysts were brought to the stand. Each detailed evidence they reviewed in this case.

Evidence includes fingerprints, hair samples and blood.

As the trial moves into it's fourth week, Six News legal expert Liz Mitchel said it's going to continue to be complicated.

"Marks continues to represent himself with no legal background," Mitchel said.

This poses an issue to the case and the trial at hand.

With a defendant representing themselves without a thorough understanding of the law, the judge and prosecution has to watch everything they say in court, so to not impede on Marks' legal rights within the trial.

The judge is also making sure that Marks doesn't say or do anything that could cause a mistrial or have the trial be thrown out if it moves up.

"When you have a case of this severity, it takes a long time to get it before a jury anyways," she said. "But with the defendant firing four or five previous attorneys, it truly slows down the process."

Mitchel said a mistrial could easily happen.

If a mistrial does take place, it's back to square one. A new jury would have to be selected and so on.

What took four years to put together would happen again.

As for the trial, Mitchel said there's no telling when it could end. The prosecution still has to rest its case, Marks has the choice to then defend himself or not then final remarks are made.

We enter week four of the trial next week on Monday inside of the Bell County Justice. 

6 News previously said the start time will be 10:30 a.m. on Monday. However, the start time is 9:00 a.m. on Monday. Wednesday will start later at 10:30 a.m.
