MCLENNAN COUNTY, Texas — A Hearing Specialist with the Texas Juvenile Justice Department (TJJD) has been arrested on charges of violating the civil rights of a person in custody and tampering with a governmental record, according to the Texas Office of Inspector General (OIG).
According to a release from the OIG, 68-year-old David Olive was working as a hearing specialist at the McLennan County State Juvenile Correctional Facility on Jan. 17, 2024.
While working at the facility, the OIG alleges Olive made "multiple" false entries in a governmental record, indicating he conducted a Level II due process hearing for an 18-year-old offender when a hearing was reportedly never held.
The OIG states that because of the "fabrication", the person lost privileges for 30 days.
According to the OIG, violation of civil rights of a person in custody is a third-degree felony under the Texas Penal Code and is punishable by a fine of up to $10,000 and 2-10 years in prison.
Tampering with a governmental record is reportedly a Class A misdemeanor punishable by up to a $4,000 fine and confinement in jail not to exceed one year.
The OIG said the case will be referred to the Special Prosecution Unit.
The Office of Inspector General is the independent law enforcement agency responsible for investigating criminal activities involving TJJD juveniles, employees, facilities, contractors or programs, according to the OIG.
